No, you can't just cut an injured player. Usually if the team wants to cut their losses, they negotiate an injury settlement.

Per Article 44 of the CBA:

An “Injury Grievance” is a claim or complaint that, at the time a player’s NFL Player Contract or Practice Squad Player Contract was terminated by a Club, the player was physically unable to perform the services required of him by that contract because of an injury incurred in the performance of his services under that contract.

If they expected a grievance and wanted to lower the cap impact, it would've been in their best interest to negotiate an injury settlement. So I'd like to believe that their medical people had indicated to BB that they were both healthy enough to find work elsewhere. It would be a bad look for them to be knowingly cutting injured players to avoid dead money on the cap.

Yes they were cut pre-season but they were under contract and had passed pre-camp physicals and participated in training camp on the field. The start of the regular season is irrelevant. So the Pats are well within their rights to claim the cuts were strictly performance-related, but if the players can convince the arbitrators they weren't healthy enough to play somewhere else, the Pats will be on the hook for their salaries.

They released him because "HE" continually complained of a hamstring and the medical guys kept working on it. Problem is that Britt got used to being paid and doing nothing and he wasn't ready to get cut and not get paid.

Mitchell is a mystery. He was cut and tried out for other teams.

Hopefully they have MRI/Cat Scans/etc. to prove they made a sound decision based on actual defensible medical knowledge.

Business end of things is always difficult. It will settle and the Pats can afford to pay. It will be forgotten as soon as the checks clear. Good luck to Mitchell. Hope Britt ends up with the Dolphins.....

Look for a scoring extravaganza next Sunday. NE 10 days to prepare, plenty of time to get JE11 some more reps, Gronk time to heal up and Gordon another 10 days to rest the hammy and gain trust in TB12.

It may come down to which defense can make a stop.

  • Former Patriots wide receiver Malcolm Mitchell underwent yet another surgery on his knee two days after New England released him, according to Kevin Duffy of the Boston Herald. The Pats cut Mitchell, a 2016 fourth-round pick, in August after failing to trade him. Injury issues have derailed the Georgia product’s career, as he missed the entire 2017 campaign and was unable to fully participate in practice this offseason after undergoing a minor procedure on his knee. After being waived, Mitchell filed a grievance against the Patriots, arguing that he should be paid his entire 2018 base salary ($640K). Per Duffy, Mitchell is still working out with the hope of returning to the NFL, although he has no timetable for recovery.


So he had another surgery two days after he was cut. Was that before he tried out for other teams, or after?
