It certainly seems on par with something like driving while intoxicated. The odds are that nobody will get hurt or die, but there is certainly an elevated and known risk the person is negligently ignoring. There are laws in some states that make it a crime to knowingly or intentionally spread communicable diseases specifically, but it certainly gets trickier when it's a minor and what the parents level of control/knowledge is or, at least, what can be proven. Tricky ground... though undoubtedly a dick and pointless move whether criminal or not.
