It usually reads "during the commission of a felony" If they got away and then one got caught later and shot - no case in my opinion. I say don't count on lawyering up - just do not commit crime.That's a fair point, but it is somewhat ludicrous that the police can in theory create a murder charge against someone by shooting their accomplice dead for little or no reason (and lets be honest, there have been quite a few debatable police shootings recently).
To take a very extreme hypothetical, say two guys commit a felony robbery, and one of them is caught pretty quick, but the other gets away and is later shot dead by police while resisting arrest. Would you be okay with charging the other guy with murder? It might be the letter of the law, but I wouldn't be happy with that.
