Not almost, never happens. There are different types of depositions. This was not a fact finding for a criminal or civil matter to be used at a trial. This was a union/CBA issue outside of the Court system. He cannot be charged with perjury based on what he said to Wells during the investigation or Goodell during his appeal.


Actually yes he can. It just nearly never happens. (I'm going to go with what the attorneys have told me prior to depostion. I'm thinking they know what they are talking about.)

I have been involved with depositions. Here is the biggest memory problem: lying. It is much easier to keep track of the truth than it is a lie...


Sure. But not remembering isn't by default proof of lying.

I think the content of the transcripts is more embarrassing for the NFL than Brady but I wonder how important it is to this appeal.


If I had to bet on it, I would lean heavily towards a ruling in the NFLPA's favor if there isn't a settlement.

i love espn brady wasn't told by wells that withholding his texts would be considered not co operateing with the investigation . pretty sure that is what brady's lawyers are for .

That's not the point of it. In order for the league to punish a player for something they have to first inform the player they can be punished for it.

Brady's lawyers were in fact correct, the CBA does not allow for the NFL to demand a personal cell phone. Now for the league to punish him for not turning it over, the NFLPA will aruge, and is arguing, the player was never informed as required.

2. Lying under oath is against the law.
The sad truth is that, as a practical matter, this reason isn’t all that persuasive either. In theory, if you lie under oath you could be prosecuted for perjury, which is a crime. The reality is that perjury charges for lying at a deposition are pretty rare. Yeah, Of course I would love a complete embarrassment of Goodell and the NFL but if they offer 1 game to Brady I would hope he takes it.


Nope, full removal of all penalties. He has the upper hand at the moment and should hold his ground.
