The vaccinated will hopefully only suffer minor symptoms with no long term afflictions It was a race against time to vaccinate and not enough people got vaccinated before this variant emerged.

Dear XXXXXXXX School Board Members and Administration:

I write both as a mother of three XXXXXXXX Students and as an attorney to express my extreme anger and disgust with this School Board decision to arbitrarily violate the terms and conditions of the XXXXXXXX filed Health and Safety Plan in the early morning hours of this date by removing the Mask Mandate.---A mandate, which would have allowed children to attend school with some reasonable hope of safety. You did so without sunshine, in the dark, without notice. You are refusing to provide a safe environment for our children’s education.

You have failed our children, this country and yourselves. You clearly have no interest or care in following science ---or well- established data. Historical trends in other schools --and in our Country show just how wrong you are in following this misguided path. You materially misled XXXXXXXX parents into believing that school would follow safe reasonable safety procedures for in person school. This prevented us, as parents, from timely opting into Cyber Academy. The Delta and Lambda variants are extremely infectious and communicable. Children’s Hospital ICU is brimming to capacity. We relied on your false promises and we signed up our children for in person school. Your refusal to mitigate this dangerous condition is deplorable and in express contradiction to your oath office.

You have ignored expert medical opinions from pediatric infectious disease specialists, many physicians who live in our school district, the American Academy of Pediatrics and the Center for Disease Control who all recommend masking requirements for in-person school attendance for the coming school year. You have illegally overridden the Superintendent’s decision and the requirements of the NA Health and Safety Plan to provide a safe environment for our children.

I urge you to speak with your Solicitor regarding your liability to students and to your employees under a State Created Danger Cause of Action. Pennsylvania has recognized the State-Created Danger Doctrine as a basis for litigation damages. Under that doctrine, a plaintiff must prove the following four elements to establish liability.

1. The harm suffered by the plaintiff was foreseeable and fairly direct; In this case Death or Grave bodily harm is directly foreseeable.

2. A state actor acts with a degree of culpability that shocks the conscience; violating your own Superintendent’s decision to require a masks—is that.

3. A relationship existed between the state and the plaintiff such that the plaintiff was a foreseeable victim, as opposed to a member of the public and general—YOU are supposed to protect our students-it’s your only real job.; and

4. A state actor affirmatively used authority in a manner which created a danger to the plaintiff or rendered the plaintiff more vulnerable than if the state had not acted at all—Well 6 of you clearly meet this condition too.

Ignoring competent, expert medical opinions and the expert opinion of your own duly appointed educators, that masks should be worn indoors by all persons in close physical proximity, particularly thousands of unvaccinated children in our district – places our children, our teachers and our other school employees health –and their very lives, at risk. This School Board also has a special duty to protect those students who are vulnerable to COVID (Students that have Asthma Action Plans/ Allergy Action Plans) and those students who are considered handicapped under the Americans with Disabilities Act. I am placing you on legal notice that if my children contract Covid because of your decision and are injured, I will take appropriate legal action against the appropriate parties. Most importantly, if any child dies because of your decision, that should haunt you for the rest of your life. Your action is immoral.

Additionally, I suspect that your liability under both Worker’s Compensation Law and under the State Created Danger Doctrine will not be covered by insurance. You have exposed yourself and this district to huge liability by your decision.

There is no demonstrable harm to students or teachers caused by mask wearing. It is merely a dress code requirement to limit the spread of contagion within XXXXXXXX’s Schools. Shame on you.

Same. My boss just tested positive 2 days ago. Fully Vaccinated, has been working from home for a year and a half, only external interactions are pretty much his family and he plays hockey once a week.

He's had some pretty nasty exhaustion and his cough is bad, but he said it hasn't been as bad as when his wife had it this past winter. He lives up in Detroit, so that may explain the cough. Air up there is crunchy.
