Im confused on this. I thought I read nba issues can only be handled via arbitration. Now Im hearing he can take it to court. If he can take it to court it is my understanding that the phone call would be inadmissable. The league wouldnt even have a defense if so. :noidea:

Not necessarily. They reported there was someone else in the room during the call. The legal analyst said that would mean there's no expectation of privacy, and that the call is then admissable.

I think Sterling would be smart to just accept this and move on. Make his billion off the team and call it a day.

Litigation for him might outlast his life.

If I'm Don Sterling I'm taking this ban as a blessing. Clippers were more of a liability than an asset.

If you can find other liabilities that were worth $15MM at time of purchase and are now worth $535MM, let me know, I could use more liabilities on my balance sheet.

If I've read everything (and understand everything) correctly the problem is a PR thing. "Defamation of the league" or "conduct unbecoming to the league" seems to be in everyone's contracts and so basically since this phone call makes the league look bad, AND it has already lost the Clippers millions of dollars in sponsorship money, that clause is what's making the league ban him. Someone correct me if I'm wrong?

The penalty system is still out of whack here. He could have killed someone and not get a lifetime ban.

He is banned from the league and team activities.

I am sure there are legal documents already drawn up that prohibit him (legally) from the law laid down by Silver.

Similar to a restraining order, a prohibited property entrance / trespassing order. but on a grander scale.

That's what I read too. "Best interest of the game" clause or something like that.

If Donald Sterling walks into a game, then the security would have the power to remove him and arrest him for tresspassing and he would be putting his sale. They could cancel his season next year all together - that would be stupid

LOL - you're telling the truth - I guess it depends on how heavily leveraged he is on that sheet. He might be worth the 535 million on paper, but owe that much, but for someone like Sterling - that is just one piece of the entire picture and it's how all of his plusses and negatives add up together

I think it was more than just the recorded racist comments. He's been despised long before this. I think this was just the final straw.

NBA commish Silver and his group of lawyers no what they are doing...

No court in the land is going to accept illegally obtained evidence, and cali (assuming she was in cali while recording) has even more specific laws about it to block its usage.
