If all that is true, why are they even taking the case to be heard?
If it as cut and dried as your suggesting wouldn't the court say just go home, theres nothing to see here?
Because it is his right to make the argument. Base on the denial of the injunction it is not likely he will be successful based on the merits but that does not mean he can't make the argument. That is how the judicial system works...the Supreme Court is the final word and until he gets that far he can argue and appeal as long as he wants.
