So the attorney and mixon both admit that he hit her. Girl apparently is currently in surgery. There is absolutely no way to justify his actions. He got mad - overreacted - and broke a young girl's face.

The attorney is asking for charges against her, because it has to be part of his defense. Apparently there is both video and witnesses showing him hit her. The ONLY thing he can claim is self defense. Great luck getting a jury to buy that a 220lb athlete was scared of death or great bodily injury from chick slap. Horseshit!

Should she be charged for slapping him? Probably so. Misdemeanor A&B. I'm fine with that. However if he broke bones in her face, that is a felony. It does not matter (as redalert who's been wrong about basically every legal statement thus far said) if he hit multiple times, etc... If he hit her and she has fractures or broken bones - it is Felony A&B. Punishable by up to 5 years in prison.

Where in the posted statutes did it say he had to be "afraid of death" or "great" bodily injury?

Of course it doesn't.

He reacted to a physical attack to prevent any bodily harm.

She could have poked him in the eye with one of her finger nails, a ring, or bracelet. He could have suffered permanent damage to his vision.

Complete and utter bull shit. This retarded mindset is exactly the reason there are more and more bitches like that out there.

link to the 'surgery' claim, please.....

It's in the link I posted.

Her atty said she's "scheduled for surgury".

It doesn't matter. He threw but one punch to protect himself from her physical aggressions.

Apparently in Texas, anybody being slapped around can't defend themselves because it's not likely to cause death. They must allow the slapper to continue the assault. :L

What I was told is apparently true. She verbally abused him, pushed him and slapped him then she got knocked the fuck out.

You curse at me, push me and then slap me you get knocked out as well. GENDER has no significance in this case.

Go Fuck a cow.

CR-8-48

"The amount of force used may not exceed the amount of force a reasonable person, in the circumstances and from the viewpoint of the defendant, would have used to prevent the bodily harm."

You telling me that he couldn't push her away? Hold out his arm to keep her at a distance? He couldn't walk away? He was sooooo in fear from a girl slap that he had to break her face?

Excessive Force

If the defendant used more force than reasonably necessary and if the force used is greatly disproportionate to the apparent danger, then the defense of (self-defense) is not available.

He inflicted great bodily injury. He has to prove that he was in "REASONABLE" fear of receiving great bodily injury. Otherwise, by definition, the force he used was excessive. He got mad. He overreacted. He committed a felony.

Again, I've said if she slapped him go ahead and charge her. I've been slapped before. Most of us have. I wouldn't punch a chick though. Now if she came at him with a weapon, sure. If she was on top of him throwing multiple closed fist punches, maybe. But she gave you a 1 time bitch slap? Anyone who tries to justify that will be making themselves look bad.

How very mature of you. You might want to check a little bit of law first though.

According to even the questionable eye witness accounts he threw just one punch. You don't know what she was doing to him. Was she going for his balls? Was she going for his eyes? Sit your cow fucking ass down and shut the fuck up.

Pushing someone is assualt as defined by the law.
Slapping someone is battery as defined by the law.

Mixon is not a professional fighter so trying to claim him punching her knowingly would cause such damage is ludicrous. He defened himself from assualt and battery.

You're a tool so go away and spend time trying to deflect from your felow longhorns raping women.

This whole thread has a whole bunch of stupid in it, but I think you took the cake. I would say 130 LB girl is defenseless vs 210 LB Football recruit. No need to defend an indefensible act. Either he is innocent or he is not, we will find out in due time. Trying to rationalize it is just weak. Men do not hit women.
