but when i read the article.... 26? i think it was? it said both parties the team and the player have to have the expectation that the players will fulfill the contract,

as i stated in the post i put below, don't think for a second the nhl won't have their hands full even with the term reasonable expectation.



i am trying to remain as unbiased as i can here, i know that i probably won't satisfy many on here with my view points, but i do believe that if you think the NHL wins easily, you have a lot more that you should be accounting for.

I'm not sure it will have its hands full, though. Gordie Howe is the only forward in the history of the NHL to play while older than 43 years old. I'm not sure how many forwards have played in the NHL, all time, but I'm betting that the odds are something to the tune of one in five to ten thousand against our Devilish friend. And that's not counting the fact that in nine NHL seasons, Kovalchuk has played 82 games just once. He hasn't missed half a season or anything, but he's no Iron Man. Gordie Howe played the maximum number of regular season games 6 of his first 9 NHL seasons. Also, Howe's seasons were shorter, so each season took less out of him. Kovalchuk just isn't as durable and plays in a league that plays more games per year than Howe did. And Kovalchuk is no Howe.

Injury and and durability concerns aside, it's still pretty clear that there is no reasonable expectation, as it were, for Kovalchuk to play to the termination of his contract. On the contrary, there's every reason for him not to, as I'm sure that once those 550k seasons start kicking in, if he's still good enough to play for the NHL, he'll be good enough to "retire" and sign a contract in Russia that pays more. Or if he isn't but still doesn't want to retire, the Devils will waive him. Bam, 6 million cap hit, gone. It's a win-win-win for the Devils. Well, actually, they lose out in the sense that they will pay more for the team in the years that they have Kovalchuk than the salary cap allows while not being able to pay less for it during the years where he'd be making the league minimum. Oh, wait, that's salary cap circumvention.

I used to feel the same way you did, that the Devils had a shot at this because of the preexisting contracts. But really, this is worse than any other contract in the league, and it's worse in ways (age, sheer difference in salary between certain seasons) that a reasonable person would be able to see. And that's the standard that the league needs to be able to turn it down. Not that the NHLPA won't put up a fight, but it's a fight they can't win, and a fight they can't afford to drag out, either.

.... trust me. i'll refrain from posting this one, its actually probably not as odd? in a way? but there is a far more out there unicorn picture my friend found than this one.
