The bat was IN the batters Box, it is his normal pre pitch routine, he didn't move the bat into the path of the throw from Martin..

Whether it was consistent or not - at that level, you are well aware of where your bat is at in relation to the catcher - and it is deliberate how you hold it there. You can deliberately try to impede a catcher without actually moving the bat at all.

Smart and legal, because extremely unlikely to get called - exploiting the rules so to speak.
