What's the league penalty for the first offense?

This kinda sucks, now he really can't screw up anymore, and he's only 21.

Draft analysts loved Aldon Smith's talent. Some questioned his immediate readiness for life in the NFL.

"Is still immature and needs to figure out what it means to be a pro," Pro Football Weekly's annual draft guide noted before the San Francisco 49ers made Smith the seventh player chosen in the 2011 draft.

Smith's arrest Friday night on suspicion of DUI lends some credence to those concerns. The 49ers' rookie pass-rusher was booked into a Miami jail Saturday morning following his arrest, according to KTVU.com.

Smith led the 49ers in sacks with 14 and is a candidate for defensive rookie of the year.

"The commissioner will review and may impose a fine, suspension or other appropriate discipline if a player is convicted of or admits to a violation of the law ... relating to the use of alcohol," NFL policy states. "Absent aggravating circumstances, discipline for a first offense will generally be a fine of two-seventeenths of the amount in Paragraph 5 of the NFL player contract to a maximum of $50,000."

Many of them think that the laws that apply to the rest of us don't apply to them. Smith was one of the last of the 49ers I thought would do something this childish and stupid.
