So intentionally throwing a baseball 95 MPH at someone's head couldn't: a) easily kill someone? b) be using equipment as a weapon?

Yeah.

Just too many exceptions or hair splitting.

Luis Resto though did get convicted of assault for removing the padding from his boxing gloves:

Prosecutors also argued that the plot was centered around a large amount of money bet on Resto by a third party, who had met with Lewis prior to the fight. Resto served 2.5 years in prison.[1]

So there's that.

A man can only take so much. I know I've lost my temper and regretted it later. So did the other guy.:lol:

If your self control is poor enough that you deliberately take an action (in the heat of the moment or not) with a very high probability of serious, permanent brain damage or death if you are successful, you can't blame that on poor judgement. You should be seriously punished for it.

If you swung a baseball bat at someone you could be subject to legal action, IMO, and this is the same thing. Either one could easily kill someone if they connect. Once you use equipment as a weapon like that you aren't protected by it being "part of the sport" IMO.

I can definitely see your point. And had Antonio connected,then yeah I could see charges.
You could tell he realized at the last second he was about to really screw up and pulled it.

I think we all understand that in sports it happens. No assault charges.

Maybe with premeditation like that boxer guy it is a stronger case.

I really dont see any difference between that and trying to hurt a player intentionally while in the pile.

I kind of agree.

But realistically no one is going to get an assault charge for shenanigans under the pile unless they bring a knife or brass knuckles.

To me it's not a significant weapon at all.

It's not a gun but give it to a 200 pound guy to fight a 300 pounder with similar percentages of muscle and similar fighting skill and the 200 pounder will have a damn good shot at winning.

That shit with Rudy was bad. It damn near killed him. And no charges were filed.
I saw that shit in the training room after it happened and it looked like someone hit him in the face with a bat.
The old man made the mask he wore after the incident.

It would take a hell of a lot to get an an assault charge for an on field incident. The most egregious soccer example I could find, for example, was Roy Keane later admitting that he tried to break Alfe Inge Haaland's leg in a match. IIRC the police investigated that but didn't prosecute him.
