Sure they do, you just don't accept it.

I already explained what the clause you are referring to covers, and that is only a fine up to a million and suspension.

Taking his team away requires an actual and "willful" rule violation, shaving points, gambling, financially not meeting his commitments, or other specific terms. They can't just act at will.

Actually you're wrong -
The Membership of a Member or the interest of any Owner may be terminated by a vote of three fourths (3/4) of the Board of Governors if the Member or Owner shall do or suffer any of the following:
(a) Willfully violate any of the provisions of the Constitution and By-Laws, resolutions, or agreements of the Association.
No one is arguing he has the right to his own opinion, but the NBA also has the right to eject any owner who's opinions are so insulting that they attack the benefit of the NBA and become detrimental to their own well being. It affects every team when the sponsers are refusing to advertise and the players are refusing to play - they couldn't even get someone to sing the National Anthem tonight before the press conference - they were already becoming paralized. Some of you are looking at these bi-laws and comparing them to contract law in the corporate world. Major league sports are not subject to those same laws. They have special exemptions and it's already been stated - Silve has the full support of the owners. Cuban was talking through his ass yesterday because he didn't want to give away his hand

Are you reading section a? It requires a willful violation of one of those rules. THAT DID NOT HAPPEN.

It doesn't matter whether it was private or public, legally of illegally recorded. It's public now and the marketplace has spoken. He's been found guilty in the court of public opinion which is the only court that matters when you're in the entertainment business. He's done.

And who's arguing that's the case? I'm saying it isn't right that he be forced away from HIS team. That they are trying to force him to sell his team. Where does it end? He's a stupid fuck for associating with a gold digging hooker. He's a scumbag for being a racist pos who treats minorities like second class citizens. I never denied that nor do I defend that. This goes farther than just racism and bigotry. Where do we draw the line? What if you are a Christian and it suddenly becomes taboo to speak of your faith because it offends other sects of the population? If you really think that's not where this is headed you're fooling yourself. The PC machine will not quit until all individuality is wiped off the map and we are a nation of like minded robots. Laugh if you want but time will tell.

True, JDM knows more about the bylaws of the league than Adam Silver apparently.

Read the bylaws. They are public and easy to find.

He knows damn well he can't win this. He also knows damn well that losing in the offseason is far less damaging to the league than admitting they can't do shit right at the beginning of the playoffs.

Doesn't that compromise the integrity of the league for an owner to associate himself with prostitutes and treating minorities like 2nd class citizens? Only problem I have with what the NBA did is that they waited so long to act. They should have ousted this guy years ago.

Article 13 is the key part to read. It lists every possible reason that someone's ownership can be terminated. If it isn't on that list, they can't do it.

And how often has that hypothesis actually been challenged in a court of law? What usually happens is these billionaire owners get on the phone with each other and say "look dude, you screwed up. Now cash in on the millions you extorted out of the city that's plastered across the jersey of your team". And it's probably going to happen again as well in this case.

Article 24(l) is the big one. The "best interests of theAssociation" clause that essentially gives Silver the power to levy anypunishment he sees fit when a violation is not specifically covered elsewhere.(It also sets the maximum amount for Sterling's fine.)

The Commissioner shall, wherever there is a rule for which no penalty is specifically fixed forviolation thereof, have the authority to fix such penalty as in theCommissioner's judgment shall be in the best interests of the Association.Where a situation arises which is not covered in the Constitution and By-Laws,the Commissioner shall have the authority to make such decision, including theimposition of a penalty, as in his judgment shall be in the best interests ofthe Association. The penalty that may be assessed under the preceding twosentences may include, without limitation, a fine, suspension, and/or theforfeiture or assignment of draft choices. No monetary penalty fixed under thisprovision shall exceed $2,500,000.

This is not the case. Any rules violation by the owner is covered from articles 13-15.

It don't matter if they try to force him to sell, HE DOESN'T HAVE TO. His franchise will just be kicked out the league. NBA is like any other business. If you make the business look bad, you get kicked out. Why is this a surprise to people?

Except they can't.

To kick him out, they must meet one of the terms listed in article 13 of their constitution, none of which apply here.

Like that's going to happen. Maybe him and LJ can get together and form an all black league with the Clippers and whatever LJ's able to throw together.

Article 35 provides enough that the commissioner can direct Sterling's dismissal, but more important the team will be paralyzed if the NBA does not schedule any games for them in the next season - Sterling would not be able to force them to schedule games

That will be interesting. An all Black league where Black people aren't allowed to go to the games.

No, the actual NBA constitution. Article 13 lists every reason a team can be taken over.

Oh shit he has found more constipational rights to bitch about.... Lol
