That was kind of my point. I think affirmative action is discrimination, born as a necessity to combat others' discrimination, but would be unnecessary if those questions weren't on applications.
I agree with you on the first part that affirmative action was born of necessity. However, I don't think it's entirely based on the questions being on an application.
The University of Chicago and MIT did a study a few years back where they found that a person with a black-sounding name was 50% less likely to get selected for a job interview based on the submission of their resume.
I personally am a big proponent of the idea of the best (wo)man for the job should get it in all cases, but I also understand that the need for things like affirmative action.
