How can the Caps trade the rights to Halak right now?

Does this mean that the Wild or any team still playing could have acquired him too? Imagine Kuemper was really hurt. Could the Wild trade for him? What about any player on any team that is out of it? Why can't anyone?

Trades can be made between any teams no longer competing in the NHL playoffs (i.e. both teams have been eliminated from Stanley Cup contention).

Another defenseman that got run out of Edmonton pretty quickly and turned out to have a pretty solid career. Call me crazy, but that seems to happen with a lot of guys that play for the Oil.

to add to that, any team can pick up a waiver player after the deadline, but wouldn't be able to use the player that season

Just doesn't quite seem right. Say a team wanted Brodeur but was still playing in the playoffs. Perhaps currently against Boston. They would not have the same opportunity to trade for his rights and begin negotiations as a team that was eliminated.

I guess I would just prefer it be trade deadline then rosters frozen until the cup is awarded so I can have the illusion that the league plays fair.
