the fact that the DA declined to file charges "after a two-month investigation" tells you all you need to know. Especially if there is a video of the incident.

I have no idea how the other side could even begin to think they would win if the DA has declined to press charges after consulting a VIDEO of the incident.

You being a lawyer and all should know that doesn't mean shit. There's a variety of reasons why the DA would not go ahead and proceed with charging someone. If they feel that it's not a solid case and there's not enough evidence to prosecute, then they likely won't waste their time. I'm not going to judge JR Smith on it because I wasn't there and I haven't even seen the video, nor care to.

It's just funny that if this exact situation happened to Whiteside, you would be all over it. But the question still remains - You think Thompson is better than Whiteside? If you do, the statistical evidence proves otherwise.

i mean- with all due respect - the fact that their is VIDEO EVIDENCE and the DA declined to charge is freaking MONUMENTAL.

All Smith has to do is attach a copy of the video to SJ motion - collect his attorneys fees and be on his way.

Cases get thrown out alone based on poor video quality, this could be the case here. I'm just saying that's possibly one of many ways the DA could've decided not to charge Smith. Like I said, I don't approach every situation like this the way you do. If this was Whiteside, you would've been all over this. It's not far fetched to think that JR Smith could've avoided this situation entirely based on his behavior in other situations.
