Mr. Sohn appears a little slow on the go here. Judge Berman has -- as most courts do when ruling on dispositive motions -- issued a judgment in this matter today. Right afterwards, the NFL appealed to the Second Circuit. So, the NFL hasn't wasted any time in getting this into the appellate process. Sohn also doesn't mention that you've got to create an appellate record for the Second Circuit to consider. That's usually done via something called an appendix which is agreed to by both parties.

While the NFL hasn't asked for expedited briefing, it still could do so.

The biggest practical impact of Berman's ruling is that Brady will be able to face to the Cowboys in Week 4. Screw justice, truth and anything else. :)
The Cowboys should win.

What's really rare is today's ruling by Judge Berman. Courts seldom vacate decisions by arbitrators, which is something that Berman acknowledged early on in his decision. The Court of Appeal will review Berman's decision de novo and it's anyone's guess as to whether they'll do.
Berman now gets free Patriot season tickets courtesy of Robert Kraft. :D

It's in the best interest of the NFL to let Brady play week 1. Look at all the added hype it will bring to the game. I wouldn't rule out Brady getting suspended at a later date though.

Who knows.

All I'm glad about is that football is finally back!!!

The chances of overturning on appeal are roughly 0.001%. The 40 pages were a full on beatdown of the NFL, written using the NFL's own words, which leaves zero wiggle room for an appeal.

i have yet to read where berman says tom is not guilty ! either way before it is settled tom brady will be retired from the nfl .

I'm guessing you don't fully understand how this works.

Killer for the NFL is that Goodell and the league VIOLATED Article 46, the one article they thought they had Brady by the balls. It states specifically that all personnel associated or connected to any investigation must be made available to opposing attorneys. Goodell would not allow the NFLPA or Kessler to depose Jeff Pash, NFL attorney who was the first person to review the Wells Report and the attorney that said that Mike Kensil and his groupies could go to Foxboro and run the 'sting' operation. Berman stated that the league violated the CBA...........that alone will get the case tossed from the appeal.
Amazing how the same haters talk about breaking the rules can't seem to grasp this part?

I'm thinking the owners will convince Goofball to drop this once they have a chance to digest the judges ruling. They will see more wasted money invested with no return. Football starts next week so they'll have all the publicity they need to keep making $.
