If you recall, as part of the Kovalchuk cap circumvention penalty, the Devils had to give up a 1st round pick in either 2011, 2012, 2013, or 2014.
With them picking the in the top 6 last year it was a no brainer to keep the 2011 pick.
But many thought that this year would be the best to forfeit given they pick 29th and many are saying next years draft is deeper.
Tom Gulitti (New Jersey Devils beat reporter for The Record) had this to report:

And now an update:
Tom Gulitti @TGfireandice Deadline has passed, Devils have not notified NHL they are giving up 2012 1st rd pick. So, they're not giving it up this year.
Interesting decision to keep this year's pick.
