The issue will be though can this get back into the court system before the start of the season? It is easy these days to continue to delay the court system so the NFL could just keep delaying it until the season starts and by that point why both since suspension would be upheld.

Hard to tell just how much money was involved. The bigger question may be who spent more? Kraft paying off the first judge he partied with or the NFL to get this decision?

Another round of bets in the office today - I have Brady starting week one, just like last time. Hope I score again. Either way I'm playing with someone else's money. I'm banking that 2-1 split in the 2nd circuit and that two of four judges have sided with the NFLPA/Brady that will merit another round (en blanc).

Either way, the only ones winning in this whole mess are the scum-sucking lawyers (and hopefully me :))

Brady, NFLPA should definitely pursue a rehearing before the full Second Circuit

It doesn't matter what we or anyone else on this board thinks. If Brady didn't do anything he has to make the decision whether or not to carry the rock forward. If I'm him and I know I didn't do anything wrong, I'd never quit. If I was part of it, then I take the decision and sit out 4.

So who's right? Berman and the 1 Appeals Court judge or 2 Appeals Courts Judges? Maybe it should go to the Supreme Court.

The one thing that may give the en blanc route legs, is that the lone dissenting justice was second circuit's Chief Justice, Robert Katzmann.

There are several avenues that can be taken.

1. Brady can put the case before the entire 2nd Appeals Court. There would be the three judges that have ruled and then 10 more would review it. Majority of the 13 would be the decision. Now that all 13 know how the first pass went, they would be able do agree or disagree with the original decision from the district court or the appeals court.

2. Brady can bypass the Appeals Court and petition the Supreme Court. The Supreme Court can review the decision and can do two things. 1) Send it back to the 2nd Appeals Court for a full hearing or 2) decide to hear the case themselves. 1% of all cases sent to the Supreme Court are accepted for a hearing and decision.

3. Brady can accept the 4 game suspension.

4. Brady can file suit in federal court for defamation, wrongful accusation, etc. etc, etc, for $500,000,000,000.
If he should win, each owner and the NFL would be on the hook for approx. $11,500.000.000.

I very well could be wrong but I believe 4 can be done regardless of 1, 2 or 3.
The last appeal was not about Brady's guilt or innocence, it was about Goodell's authority to suspend. Brady has been defamed with or without an additional appeal.

So he could appeal again and sue for defamation at the same time.

They upheld the suspension because the CBA says Roger can do what he did. I under stand Roger has the "power", but one would think you kind of need proof, which they don't have. Brady fucked himself, agreeing to the CBA and smashing his cell phone. I said from the start this was going to be what did him in. He knew they were out to get him, so why not hang onto the phone? Smashing it looked bad, even though you can get all the info you want from the ball boys or Cell company.

Personally...if he is innocent, he needs to retire and sue the every living shit out the NFL, owners and everyone else under the sun (even Kraft). Make the NFL turn over their phones, emails, and such. You take a suspension, you admit guilt. You have nothing to hide, take it to the courts not being an NFL player. Given them everything and make the league do the same.

I am curious, has Kraft lifted him face from Goofballs nut sack yet to realize his QB is done for 4 games?

Also it was nice to see Brees say what he said. Might open some ears...

Did anyone ever see Brady's destroyed cell phone? Did you ever see a photo of this supposed phone that was destroyed? Did anyone ever testify to picking up the pieces or seeing anyone pick up the pieces of this destroyed cell phone.

The truth? The phone was never destroyed. The phone is in Donald Yee's possession. Why? Because it's evidence that there were never any texts or emails exchanged. The last thing an attorney wants to do is turn over evidence that someone else can destroy "by accident".

This is far from over. Brady has a number of things he can do and the media is not privy to anything that he's even considering. There are way too many smarter legal minds out there who know a hell of a lot more than anyone in this board or the news media about what can be done and how to do it.

Then why not turn it over to an independent party to prove his innocence? So if that is the case then turn the cell phone that you say still exists to the judge and say "here you go you look at it...we don't trust the NFL to not destroy it or tamper with it." I mean that is pretty simple and the easiest way to completely close the book on this whole case. Yet at this point that still has not even come close to happening.

No, the NFL did NOT make an example of Brady, Goodell exerted as much authority as he thought he could get away with. Why didn't he make an example of the NY Jets for tampering with Revis? $100,000 fine for stealing a player? If the Patriots had done that, Kraft would have paid $10,000,000 and lost his next 5 first round draft picks.

Everyone hates the Patriots for one thing and one thing only.......success. If the Broncos, Rams, Cowboys or Raiders had been equally successful, everyone who wasn't their fan would hate them as much as they hate the Patriots. What the haters don't fully understand is that now Goodell can do whatever he wants and their team may be next. If Goodell doesn't hand out equal punishment from here on out, the Patriots WILL sue the NFL and they'll easily win even if it goes to the Supreme Court because Goodell has set precedence. See this is what Patriot fans sometimes struggle with...We don't dislike your team for being successful. Plenty of teams have been successful in the NFL and done just fine. I mean the Packers are one of the most successful teams in NFL history and they get voted as one of the most liked teams every single season. It has more to do with the fact that the Patriots are viewed as an organization that is more willing to bend the rules to win than any other team in the league. Whether that perception is true or not who knows but that is more the reason people struggle with the Patriots and feel like they have gotten away with a lot. It also sounds like the owners were pretty fed up with it as they are the ones pressuring Goodell to hand out such a punishment to the Patriots. Goodell is just a parrot that echoes what the owners tell him to do. If you want to blame anybody in this situation you should be blaming the other owners not Goodell. At the same time you should be asking yourself why are the other owners so upset with the Patriots? You can say success but to me it goes much deeper than that. Plenty of owners have been successful before Kraft and not had the other owners ticked off like we have seen in this situation.

As for precedence being set...not really. Goodell has said that a big part of this punishment was because of multiple violations without the team really showing any kind of remorse. So yes if another team continues to ignore the rules then I can see precedence come into play but a team that has been good for quite some time and gets caught doing something they are not going to get this harsh of a punishment.
