SCOTUS is not going to take this case. And even if they did, there is almost zero chance they would rule against the NFL.
It is the best interests of both Brady & the Patriots to accept defeat & take the suspension at the beginning of the season. If he hadn't dropped the notion of appealing to SCOTUS, a scenario could have easily played out where Brady ends up serving his suspension during the playoffs.
Brady wasn't suspended for deflated balls, he was suspended for obstruction. Whether Patriot fans want to admit it or like it, the courts have ruled that the per the CBA, the NFL does have the power to suspend players.
In the end, all that Brady & the NFLPA accomplished in tediously taking this through the court system was to affirm the NFL's power & making lawyers even more wealthy. The NFL came out stronger than had Brady just accepted his original punishment.
The NFLPA is just throwing anything at the wall to hope it sticks. They overplayed their hand & now are in it till the end, hoping they can complete a hail mary. And why not, it's not the NFLPA's money they are playing a losing hand with.
A work stoppage after 2020 hurts players far more than it hurts owners. So good luck wrestling away a long time power the NFL just got affirmed through the courts.
