So he has absolutely no reasonable expectation of a shred of privacy in his own bedroom? Whatever he says can and will be sold to TMZ and you're cool with that. Sorry, NOT ME!!!

If my wife tapes our conversation and sells it to TMZ, I'll be pissed at my wife but I won't blame the public if they are pissed about anything that I said. Yes, he can have all the privacy he wants if he doesn't have a crazy broad in the room with him!!

What you do in the privacy of your home is your business. Now if she went into his home and recorded those conversations without his permission in his home - that might be illegal, but once he went into her home -her domain, he gave up his right to privacy even though he trusted her and expected it. It is illegal for anyone to record a conversation public or private - just find the law that proves me wrong. Either way we are not talking about criminal law - we are talking about a civil matter and your opinions won't stand for his defense because it isn't what he said that they are taking action on. The are taking action because his opinions and personal views do not reflect those of the NBA. It would be no different then a private school terminating a teacher that was teaching third grade children by day and stripping in a night club on week ends

Wrong. Any private conversation being recorded is illegal in California. It doesn't matter if you are in your home. It is illegal, and she is subject to both criminal action and a civil suit.


Does it have much relevance to the case of Sterling v NBA? Probably not. He didn't breach any contract by having a private conversation, so until he does there is no ground to boot him. The only way it becomes relevant is if the NBA wastes time making the case that his conversation was a contract breach, in which case the fact that it never legally should have seen the light of day and he played no role in that is relevant.

I completely agree with this. 100%. Revisiting that past only fosters racism today.

The things is, I think the black community should be given leniency in terms of their time frame to move on from it.

Its like if you wrong someone horribly and then apologize. You can't expect them to be fine with everything right away. It would be best for everyone if they did (assuming you were sincerely apologetic). But moving on is their decision and in their time table.

the problem is this is completely absurd.

Blacks have been, and still are, discriminated against in EVERY facet of our society. From the educational system to the judicial......simply saying "its over now, get over it" means NOTHING when they STILL aren't given equal opportunity or chance. This has been proven over and over and over - there are real world consequences to this. The problem is VERY complex. Simply refusing to talk about it solves nothing.

As someone who has no problem with the way the NBA is dealing with Sterling, I can at least admit that this is true.

That said, I think my opinion as a bystander is probably more well-grounded than my opinion would be as someone in the middle of a life-altering emotional incident.

He breached the contract when his personal opinions on blacks became public because his opinions are unacceptable in the NBA and under the terms of the NBA, the courts won't get decide the merits - the arbitrators in the NBA will decide. You need to get it straight - this is not a civil matter in the courts. It is a private matter in the NBA and the power of the NBA can remove him

A personal opinion or conversation IS NOT A CONTRACT BREACH. When they try to take his half a billion dollar franchise away, you'd better believe it will end up in court, and he will win.

There are a long list of reasons for an arbitration agreement to be thrown out and this will go to actual court if it gets that far.

Doubt it - this is a civil matter and she recorded the conversations in her house - just like Richard Nixon did decades ago before he had to turn them over to the justice department. There isn't going to be criminal charges - the NBA just banned him for life and fined him 2.5 million and are moving to remove him from the league.

I am not an 81 year old man sleeping with 23 year old girls and showering her with gifts worth millions of dollars either and I'm not the owner of an NBA team ranting about not wanting blacks around me. Sterling is going to be fine - he's going to walk away with 535 million dollars or more for his wife and children. What everyone is saying, however is that his personal opinions of black people are not acceptable for business owners in the NBA and the two cannot and will not be allowed to co-exist. If he wants to join the Klan, then fine - let him, but not in the NBA

It was my first real look at him and I was shocked. They should have had someone with public speaking skills deliver the release. At the very least he should have been very familiar with the statement and prepared to deliver it fluently.
