#H9Csuck!
This is pretty astute tf and I fear it's probably dead on. If this kid was actually forced to play with a concussion and the University knows this, it's a shame they are fighting this just because they, like you, believe the Lawyer cannot provide the burden of proof necessary to win the case. There are a lot of possibilities as to what could have gotten it to this point. One would be how it was brought about in the first place. It could be that the kid got a lawyer and they filed the suit without first trying to negotiate with USC.
It could also be that they tried to negotiate with USC, but didn't like USC's response. I'm sure his family is involved in some way in this (as they should be), so who knows what they are saying/demanding?
It'll be interesting to see how this all plays out. Unless the kids lawyer has some proof that Kiffin and/or other coaches actually did force the kid to play, he likely loses this case if it actually goes to trial. Which is why I hope they just settle out of court to take care of/help the kid.
BTW I don't think this is isolated event with USC. Organizations with their Lawyers don't really care about what is actually right or wrong just what can be proven in a court of law.
There is no justice in that mind set and like I said earlier it is just shameful...
