Interesting, because, if I'm not mistaken, Swarm is the one who claimed victory on said bet and tried to force someone to change their avatar based on this non-bet bet. Naughty Max then pointed out that by Swarms rules, where the other person apparently doesn't have to agree to the bet for it to still be official, that Swarm lost the bet then.

Basically a "what's good for the goose..." kind of situation.
