That's very stupid...because then you're basically asking the commissioner to turn his back on the officials. And he's already served some games. Makes me think they wanted to go to neutral arbitrator.

Wideman should have sent his texts from an iphone. Apparently even the FBI can't access those.

Which by my powers of deductions means a teammate ratted him out.

Brian Burke tells @timandsid he's "amazed" by how long Wideman appeal took. "We've been asking for a result for several days."

Well, Herr Bettman had to make it look good, I mean, he couldn't come back a day or two later and say there would be no reduction, he Hollywooded this performance.

Also, I should add that it's pretty bush league by Bettman to release Wideman's text message.

A series of tweets from Elliotte Friedman explains the text messages:

Elliotte Friedman @FriedgeHNIC
Okay, here is the explanation...

Elliotte Friedman @FriedgeHNIC
Because this is an arbitration hearing -- basically a private court -- neither side can say no to this kind of a request (more)...

Elliotte Friedman @FriedgeHNIC
Provided information isn't privileged, both sides have to provide written communications from witnesses.

So, if someone wanted Don Henderson's texts messages, they had to be turned over, as well. And they were. That's the explanation.

Wow...really?

Not exactly a subpoaena, more of a discovery request (tell us everything you know about _______, pretty please?). Plus there is probably some weird employment law at work as well.

The only ones the FBI cant get are phones encrypted with certain encryption software, hence the request for Apple to blow up the operating system.

A standard iPhone is trivial to get into.

This battle is a huge one, but trust me on this - Androids, properly configured, are infinitely better than iProducts if you want privacy.

And avoid Windows phones. Like the plague.

Either side *can* say no all they want. However, that usually just elevates it to a non-private proceeding.

Arbitrators are much friendlier than judges. And court orders and search warrants are a shit ton harder to ignore. And if it's discovered you destroyed anything between "discovery request" and "warrant". It will not go well for you.

The National Hockey League Players’ Association (NHLPA) issued the following statement this evening regarding the National Hockey League’s (NHL) decision to uphold Dennis Wideman’s suspension for 20 games:

“We are extremely disappointed but not surprised that Gary Bettman upheld the decision of his staff to suspend Dennis Wideman for 20 games. This decision completely ignores the effects of the concussion that Dennis sustained when he was driven into the boards eight seconds before colliding with the linesman. We will appeal to the Neutral Discipline Arbitrator in order to have this decision overturned.”

This is all so weird

I didn't know Ken Campbell was an expert in diagnosing concussions and whether or not a person still has concussion-related symptoms.

I think it all boils down to the fact that Colin Campbell didn't believe that Wideman suffered a concussion and deliberately hit Don Henderson and Gary Bettman supports Campbell's decision. Now I have no clue whether or not Wideman suffered a concussion, but it also appears that the league isn't buying Wideman's story that it was an accident (with or without suffering a concussion) and there was no malicious intent. Oh well, the lawyers are happy.
