Penalizing both players is fine is the time fits the crime. If the NHL wants to not allow these types of slurs that's fine they need to explain that to the players and set an acceptable punishment if that's $2,500 then that works. The punishment for risking injury to an unsuspecting player should be a no questions asked suspension, because if they do not take that hard line player will continue to be hurt and suffer shortened careers.

My point was though where is the discussion on the discipline for the sucker punch?

I have no problem on discipline of any kind for things avery did. I'm just sick of people saying that a gay person who is offended by this is overly sensitive. If a someone calls a black man the n word no one says he is overly sensitive if he gets pissed.

A person can say pretty much whatever they want whether the masses agree with them or not. It is a right then countless liberty loving and patriotic souls have fought and died for. In my opinion those people/groups who want to take away our 1st amendment rights should be prosecuted for treason and executed in public.

That's not how the first amendment works actually. There are limitations to freedom of speech. I mean that in the literal sense - you can't just say whatever you want. If patriotic souls fought and died for an absolute freedom, they operated under a misapprehension.

Oh, and this did get out of hand while I was in the Stamkos thread. I didn't start the fire. It's been burning since the world's been turning, yo. :brick:

i do. depending on the person i might not say it to their face, but i do think thats being too sensitive too

IMO words shouldn't piss anyone off unless you're calling out something like a recently deceased relative, a personal struggle you are dealing with (sickness, family trouble, etc.).. stuff like that.. i dont consider being homosexual or a different color to be a personal struggle like battling cancer

Actually I do... But apparently I am a heartless asshole. I find racial slurs to be humorous, as do many black and hispanic people I know.

They call each other ****a all the time and nobody gets pissed just like gay people call each other out when they do somthing womanish and say man that was gay. Why is that ok? It's because they did it themselves and cant blame each other.

Fair enough, You've been civil to me so I can respect that. This really got out of hand, I just didn't want Simmonds to get off scott free.

Yeah, it's especially tough when everything you want to watch is 3 hours ahead. I hate it when I have to fly East because I have to stay up until 1am to watch my teams, lol.

Yeah, that's one thing I really hate about living out here. I miss a lot of good/primetime games because of that.

No worries man, I remember you saying that it was taking awhile to get used to. As for me, I can't complain, it's finally starting to cool down from 100 degrees to 80 degrees. :D

It's not the person receiving the comment that is the issue the NHL has to deal with here.

If the NHL does not take a hard stance (hehe, I said hard) when the league's only player/LGBT activist is called a gay slur, the NHL looks anti-gay. If the NHL did not take a firm stance (hehe, I said firm), when Chris Simon called Mike Grier a racist slur, the NHL would've looked anti-black.

It's a league image issue, not a player-to-player issue. That's why the big leagues have to nip these things in the bud and be stiff in resolve (hehe, stiff).

]

Hence the pretty much part. The real issue comes down to the interpretation of what was said since it is impossible to infer what the speaker meant when he/she said it. I mean there are so many examples of interpretation issues, for example. If a white person says "he's my ****er" it's automatically presumed to be in a derogatory, racist fashion. If a black person says "he's my ****er" it is not automatically assumed to be derogatory but could be seen as a comment in paralell to "he's my boy".

Here is what I've found on to clarify what freedom of speech means...

Freedom of speech in the United States is protected by the First Amendment to the United States Constitution and by many state constitutions and state and federal laws, with the exception of obscenity, defamation, incitement to riot, and fighting words,[1] as well as harassment, privileged communications, trade secrets, classified material, copyright, patents, military conduct, commercial speech such as advertising, and time, place and manner restrictions.

Criticism of the government and advocacy of unpopular ideas that people may find distasteful or against public policy, such as racism, sexism, and other hate speech are almost always permitted. There are exceptions to these general protections, including the Miller test for obscenity, child ****ography laws, speech that incites imminent lawless action, and regulation of commercial speech such as advertising. Within these limited areas, other limitations on free speech balance rights to free speech and other rights, such as rights for authors and inventors over their works and discoveries (copyright and patent), protection from imminent or potential violence against particular persons (restrictions on fighting words), or the use of untruths to harm others (slander). Distinctions are often made between speech and other acts which may have symbolic significance.

Flag desecration has continually, albeit controversially, been protected by the First Amendment, despite state laws to the contrary. A Constitutional Amendment has been introduced to contravene the First Amendment's protection on flag burning, but it has failed to acquire the requisite enactment by all the states.

I'm not saying that this kind of speech should be allowed in a sport that is attempting to become a more player friendly enviroment but I am still very upset that hrutful words seem to be of greater importance then physical assault to the NHL and world in general.

haha thanks.. i understand your point of view.. i just dont really agree.. and i'm ok with simmonds getting punished as long as avery does too.. if we're going to punish people for being heard for saying bad things, then we need to punish everyone who says bad things

i'm all for good solid discussions, helps pass the day

I'm with you Jeff I think people have become way to overly sensitive and need to learn to just shrug some things off. It's not like someone threw a box of dildos and tampons at him. :ss:

I respectfully disagree. I think the best thing the league can do is keep it's distance. I don't see this as an "if you're not with me than you're my enemy" type of deal. This isn't all black or white, there are those who are indifferent, which I believe is the best stance when in the public eye.

That's because minority communities have a psychological need to reappropriate disparaging terms and give them a new connotation that way the next time someone calls them that slur out of malice, the word doesn't cut like a knife.

Did Meredith Brooks teach us nothing, folks?
