lol the OU fans are ready to bring down the federal government, legal system, etc just to defend Joe Mixon. I bet in other threads they'll bash Baylor for putting football above the safety of women.

It's not that, Lance. The point we're trying to make is once a person's punishment is completed it's time to move on. If he had deserved serving hard time it would have been a sentence handed down by a judge and the system would have had its say. In this case the system decided on a certain punishment, the punishment was served without a long drawn out appeal process and it's over with...........until the media digs it up again and then they rip the scab off and the whole thing is argued over again. At some point a person should be able to move on with their life after atoning for their past transgressions.

That's the context I was talking about. So, yes, I do.

And I think we might still be having the conversation for the fact that a high profile player at a football powerhouse broke someone's face. But public opinion would probably differ to some extent.

*For one, we all would be making fun of a guy who slaps a college football player and then got jacked in the face. Because the interwebz is a cruel and unusual place... usually.

The law deals with proportionality. For better or worse, that is based on the potential harm, not the Defendant's action. So under the law, Mike Tyson may be committing a criminal act in a situation where I would be justified if we both threw a punch.

If she hit him first, it is definitely relevant for sentencing. It doesn't affect the crime he is charged with.

Here, let's clear the air a bit....
"Typically, both assault and assault and battery are charged as misdemeanors. Simple assault is punishable by a maximum of 30 days in county jail and/or a fine of up to $500. Assault and battery carries a maximum jail term of 90 days and/or a fine of up to $1,000."

That excerpt is from a legal group blog from here in the State of Oklahoma. It's fairly clear and easy to understand. There is no gender basis in assault and battery in Oklahoma. That was written out some years ago by several legislators, one of which provided his professional opinion of the matter where he professed that the District Attorney failed to serve the intent of the law...and he knew that to be a fact for he helped craft the law.

The facts as they stand are that an inebriated woman and man of unknown mental faculty had a verbal altercation that escalated into physical contact. Verbal altercations can be viewed and prosecuted as assault. Physical altercations can be viewed and prosecuted as battery.

All witnesses interviewed detailed that the woman initiated verbal abuse and physical abuse on the man and was clearly inebriated.

Similar to "Stand Your Ground" laws, the man was well within his rights to defend himself after suffering abuse at the hands of the inebriated woman.

The man had just turned 18 years of age that day, was a student athlete at the University of Oklahoma, and had no prior criminal history. The woman was at least 20 years of age, was a student at the University of Oklahoma, and had prior criminal history and warrants out for her arrest at the time of the altercation.

So cast your aspersions on this young man who was charged, given a sentence in our legal system...punished by the college he attends, and crucified in local media and by legal professionals from Wisconsin. It really doesn't matter.

This is a very intelligent post in a bubble, but it misses how self-defense works (see my last post). And broken bones means it is an aggravated assault (felony) not a simple assault.

Feminists have been screaming for "equality" for decades. They don't want equality. Equality would suggest this case be handled as though the girl was an adult male. They want to have their cake and eat it too.

I have zero problem with the fact Mixonwas punished, and I think he deserves an opportunity to show he can move forward as a productive citizen and leave that poor decision behind. What I have a major problem with is the double fucking standard, which the DA admitted to. This girl has a record had a current arrest warrant out in her name. Mixon's record was spotless to this point and was in the wrong place at the wrong time and reacted poorly to a bad situation after being both verbally and physically assaulted first. Mixon gets charged fairly and pays his price. The girl on the other hand receives no charges and no formal punishment, which the DA admitted wouldn't have necessarily been the case were she a male. That's fucked up and chicken shit.
