Not exactly. The video also shows her physically assaulting him first.

I haven't seen it, just going off what I heard. If she hits him first, that might give him slight justification, but he's still 10x more powerful than she is and has to know the limits.

As far as that goes, diversions for 1st time offenses are pretty common. You complete requirements and such, and then it gets taken off your record.

Even without the diversion/delayed sentence he was at best looking at the same exact punishment. Probation, probably have to take some classes, do some community service and the difference being it stayed on his record.

well, with the benefit of being a star athlete comes the responsibility to know that more eyes will be on you. Average Joe and stud big program RB aren't the same people. His name and job would get him out of some things that you and I wouldn't get out of, and into other things that you and I wouldn't.

Okay, you can keep thinking that you "know" how the system works or how I operate based on one case. I gave you a very logical reason why I wouldn't do what you said I do.

Also, if your system were the case and the prosecution always overcharged, we would be losing trial after trial. And that's objectively not the case.

I make an offer in the case. The vast majority of time people plead to the offer because my offer is fair based on the facts of the case. A significant minority of the time, I am forced to dismiss based on witness issues. A pretty small percentage of the time, a case goes to trial. An even smaller percentage of time, I amend my offer based on new facts- whether it be facts not included in a police report, me hearing what my Victim says happened, a Victim's desire to wrap up the case quickly, me hearing about the Deft's life circumstances, or me losing an important but non-essential witnesses.

You can think what you want to think, but that's what my caseload is like. And that's true for my co-workers and the offices I student practiced at as well.

You are full of shit.

Hell, you don't even have the facts of the case here and you are trying to tell me how guilty he is.

I would say his name and such would get him out of being charged to start with, but beyond that what happened I don't think is abnormal.

I got the same kind of treatment a few times when I was in the military. I never showed my license first, I always showed military ID. Never got a ticket, and never got in trouble for things I could have.

I'm not excusing him. Please don't misunderstand me. I'm just saying the whole situation is fucked up from multiple fronts.

You're a state prosecutor, right? I doubt you are as pure as you want to believe but if you're Federal I know that's a bull shit system. I've had two friends who were convicted under federal conspiracy charges and I know they can stand before God someday and swear they never knew what was going on. But a chicken shit federal judge and a federal prosecutor convinced 12 morons they were somehow involved in a plot with people the prosecution even admitted they had never met. If you can admit there are too many innocent people in federal prisons. maybe people will give you the benefit of the doubt that you're doing the best you can.

I believe 4MnB20. He obviously knows the criminal justices system better than the guy who went to law school and works the cases on a daily basis.
The other thread makes a hell of a lot more sense now that I got to read the responses in here. :pound:

I am assuming this reply was meant for @Smart and not me.

Dude, you literally know nothing about Smart. If you'd been around going back a few years, you'd know why we're slow to eat up his bull shit.

Isn't he going pro?

The timing of this is ugly. Talk about ruining a career.

LOL, this won't effect his draft status. You can beat down all the women you want in the NFL and be fine. Now if he was running an illegal dog fighting ring, he would be fucked....

Vick is still in the league, i think. Ray Rice isn't. Videos are a problem in the NFL.

Vick served prison time, was out of the league for what, 2 years? He's back in the league b/c he still has some worth as a backup QB. Rice has no more value, otherwise he would still be in the league.

Yes, sir, it was. I should have put the comment in a separate box but it was kinda early in the morning and sometimes I forget to proof read. Smart is a tool if he can't admit that good, innocent people get convicted in our criminal system way too often. The game's rigged. The judges are frequently former prosecutors. The juries are piss ignorant of all the facts because a trial is not about finding the truth, the whole truth and nothing but the truth.......even though prosecutors like to pretend it is. The courts are a conviction machine. Sometimes they get it right and bad people go to prison. But the number of people who get screwed is way too high in a country that pays a lot of lip service to "Truth, Justice and the American Way".

A trial by a jury of your peers is about assigning blame and asking a panel of 12 people too stupid to get out of jury duty to sort through the bull shit. That's the gun the justice system holds to your head when you are trying to decide whether to plea down.

Years ago when my Dad was still alive he hired a guy who had just been down for 7 years for Armed Robbery. Dad asked him "well, did you get it out of your system?". The guy said "yes" and said he just wanted a second chance. So Dad hired him on the spot and he worked for years and did great. We have hired a slew of people over the past 30 years who have just gotten out and need a good job where they can prove themselves. And our experience is these people are appreciative of their opportunity to turn things around. My only two rules are (a) they never talk about their past with people and (b) they keep their nose clean.....which includes drug testing in some companies. Black, White, Hispanic, Asian, Men Women, Pretty, Ugly...I don't care what they look like. I just think everyone deserves a sincere second chance.
