So did Schefter violate a hippa law by posting that chart from the hospital?
My assumption is yes, unless the league or teams have some prior agreement with the network to allow these kinds of things to be accesible. Maybe JPP said it was okay, but the question I have is who showed it to Schefter, and why.

Who knows? Could have been his agent or someone that has a contract that allows him to share medical records. I see no reason WHY, but let's not jump Schefter and forget about the story.

Not sure how, unless he walked into the Hospital and stole the reports himself. These records are only as secure as the people who have access to them. Someone, either the hospital, JPP, Giants or the NFL leaked them to AS.

like I said, there may have been prior consent. I would hope that no health professional would just let a reporter take pictures of a patient's file. If I ever blow my index finger off in Florida I'm going to make damn sure ESPN doesn't come snooping around.

haha. If he didn't have the actual record to post this would be less of a story. He could say he "guessed and guessed right". But the photo of the record shows that someone provided confidential info. Now the question is who did that and did they have permission.

ESPN sent a mole to the hospital with a briefcase full of cash. Anything for a story.

Pretty sure no. Different standard for media.

The person who photographed that operating report would be the one.

Just read that as well. Never knew it. Media can post records of others. It's the person that gives the records to the media that is in trouble.

maybe more than one career has ended because of this. If Schefter paid some hospital employee for that pic he is toast. I doubt that's the case though. Although I doubted that any unsigned star athlete wouldn't be so dumb as to have his hand blown off as well

There's a piece in the law that says something about using the disclosure of PHI for "personal gain." A case might be made that Schefter did in fact stand to gain from distributing someone's personal health info, at least in terms of showing how 'inside' he really is. But that's probably a stretch.

So this is a pic of what a hand that has had right index finger ray resection looks like...
image.jpg

What this means is that the knuckle is removed as well as the whole finger. The purpose is to remove the "gap" that would be left if the knuckle remained.

Wow.
