its a great concept actually. All you need is reasonable doubt.
If they are both pointing at each other & neither can be proven right (or wrong) The jury wont know which one did it & they both get off. So it makes sense for both sides to say they werent together.

That's a good point and often works on tv shows. Now let's figure out how to make those 70 people at the party forget what just happened
