"Apart from the obvious notion that the NFLPA wasn’t a union during the period of the lockout and thus had no ability to do anything on Benson’s behalf, Benson argues that he wasn’t an employee of any team during the lockout.

We’re also told that Benson didn’t even know about the August 4 letter agreement, and that the NFLPA failed to respond to efforts on his behalf to obtain information regarding the resolution of the application of the personal conduct policy to incidents occurring during the lockout."

Smart move by Benson.

He files suit prior to his appeal. It puts pressure on the league to rescind the suspension so this doesn't turn into a fiasco. It'll end up looking bad for everyone.

No way this goes anywhere near court, or makes it passed Tuesday. Unfortunately, Benson will be around the entire season. Scott with 2 carries despite Benson's 17 carries for a whopping 64 yards.

Scott still ran for 10 yards on 2 carries. He earned more carries. If not for that, because Benson blows.

Just pointing out facts. SF has now gone 25 straight games without allowing a 100 yard rusher. FACT.

Benson is nothing special. He's light years better than Scott ever imagined to be, though. There's no comparison at all. None.

The Niners haven't allowed a 100 yard rusher in 25 straight games. Bernard Scott wasn't gonna be the guy to break that streak. Buy a fucking clue...or keep making yourself look like a fucking retard.

I just want Benson gone, and it has nothing to do with the relative quality of Scott.....Ced should take Simpson with him, too.....

All that said, back to the topic. Initially, I had not thought of nor would I have expected him to file suit PRIOR to his case being heard on appeal. Had I, I wouldn't have been so adamant that a case would never be filed*. Yes, I believe this is a smart move. He's playing a game of chicken. Hoping the NFL wants no part of the negative PR this brings. HOWEVER, I still stand by him having no leg to stand on if his appeal is denied and this actually goes to court. In which case, he only has to lose from Goodell and his rep as far as the NFL is concerned. In which case, in a way, I guess you could call it "idiotic".

*if his appeal is denied, I still wouldn't be surprised if the lawsuit is dropped before it hits court. Only furthering my opinion that the lawsuit is a "negotiating" ploy.
