He was given, and passed to breathalyzers, and passed the field sobriety test...

DUI's are the most common charges tossed out of court because of probably cause issues...he essentially is being charged because he passed the test, but the cop "thought" he was drunk and wanted blood...and refused. This was the same area he punched a cop, so the whole thing is a bit stinky....

Probably means he was high as a kite...

Zero chance he gets convicted of DUI...
