You realize it was their defense attorney that said that, right? That's what the defense attorney is supposed to say. In the link I posted from the LA news, the DA said that they couldn't determine who was in possession of the drugs and gun.

This is what the DA said...

Jerry Jones cited insufficient evidence in proving who was in possession of the gun and the drugs, thus, he is dropping the charges.

...prior to saying he didn't want to ruin their lives. The DA said nothing about an illegal search. The defense attorney would try to mount that defense, because that's about the only way you can get off when you're caught with that kind of stuff. The defense attorney saying it was an illegal search means absolutely nothing.

As a prosecutor, I really hope that this quote isn't real. Refusing to file because of joint possession issues or a potentially illegal search is fine. The above quote is not.

I forgot this is right up your alley. I was under the impression that drugs were one thing that it didn't matter who has it. If you are in the area, you can be arrested and charged, no?
