What if the XFL said they will only test for PED's and any criminal related suspensions would come only if civil law enforcement had enough evidence for an arrest?

Would some NFL players take a pay cut for more freedom?

Early goal shouldn't be to overtake the NFL, but if they set discipline guidance more favorable to the players they could still a few and over time have a shot.
It wouldn't sit well with us old people but the younger generations might jump on board.

It was bad last time, and the things that were supposed to set it apart weren't compelling before. Probably the only thing worth tuning in for was the fight for the ball.

Make it a league where you are demoted to if you're the typical dumbass, thug NFL'er. Commit your crime, sentenced to the XFL for the remainder of your career for min. wage.

Seriously....I don't see how it could work. There have been several attempts and none have really worked. Isn't there still an arena league?

The Bills are worth 1.6 billion as the least valuable franchise. That's more than 16 times what the XFL was worth the last time as a whole. Good players won't play for what to them is pocket change. Hence the product will suffer and people won't watch.
