I would guess the NFL has some damn good lawyers, because lawsuits are a fact of life for them. They don't back down if their lawyers tell them they would win. Obviously their lawyers told them Uhhh you might want to rethink this because you got a good chance of losing. Now lawyers hate saying those kind of things, because court cases = money.

They weren't going to lose. There's no grounds for it.

I feel the rule was unfair, I mean what right dose the NFL have to force Browner to take a drug test when he was playing in another league. (Which where counted against him) If I move on from another job they shouldn't be able to force me to keep doing there test. And that's why I think the NFL backed down.I also feel Browner should get time served as he did miss the last five or so games. Anyways I hope it works out for you and Browner unless he plays Seattle. Side note re-watched a lot of his rookie year, man did he get tons of INTs. Damn.

If you want to maintain eligibility to be an NFL player, it is perfectly reasonable to mandate continued drug testing. Should someone be able to take a year off to go juice and come back like nothing happened?:noidea:

Yes he no longer worked for the NFL, in fact he was playing for a different league and didn't Ricky Williams basically do that?

It doesn't matter. To maintain eligibility, you should be required to keep up with drug testing. You may not currently be an employee, but it should simply be part of the process of staying eligible to be in the league. If you have no interest in coming back, then don't take them. But if you do, you have no reason to complain that you are held accountable for not fulfilling the tests you contractually agreed to.


I think Ricky Williams actually officially retired, then went through whatever process to unretire. I don't think you should be able to unretire like that, but if browner didn't want to be subject to testing he could have went through the same process. Not doing so was on him.

Just because you keep saying that, doesn't make it true. The NFL is not in the business of losing cases, or even settling them, so this decision could not have come easily. Their actions prove that they felt that it was a good chance that a judge was going to disagree with your claim that "there's no grounds". But what does an army of high priced labor lawyers know anyways?

That's fact. As he was not retired, he was subject to the drug testing policy to maintain his eligibility to play in the NFL. Not taking a test is and always has been treated as a failure.

Tell me what legal case browner had? Everything was completely above board, he failed to meet his obligations to remain eligible, and the league enforced the rules.

They simply didn't want this to be a long and public dispute.

We can't keep the aging veteran guy's who are demanding pretty big money… We just can't do that with our core needing to get locked down next year… Most of what we've lost isn't star guy's … Tate kinda was but other than that most lost production a bit from age...

The NFL backing out and reinstating him after he turned down the settlement offer proves that they didn't like their chances going forward.

Do you think that it's a coincidence that the NFL reinstated him just weeks after filing the lawsuit, right in time for free agency? The NFL comes off looking very weak here, you cant honestly believe that they're OK with that. They were beaten, the NFL lawyers knew it, Browner's lawyers knew it, now the rest of us know it too.

They didn't reinstated him after he denied their settlement offer though. They reinstated him when he brought the lawsuit.
