He's saying there is enough there to see Brady knew about the deflation of balls by the two ball boys and they were doing it because that's what Brady wanted. If Roger didn't over punish the final outcome would be different. If Berman felt Brady was innocent he'd have vacated the suspension upon the first appeal. He didn't do that, he told b I think sides to come to an agreement,because he DIDN'T want to have to make the final decision. The way I understand it, Berman had two choices, either VACATE the suspension or UPHOLD it. If the penalty was one or two games or just a fine, it probably gets upheld. If innocent why did they fire the two ball boys? It wasn't the NFL.. it was Kraft and the Pats that did it. And why are they threatening a lawsuit against the two if they give any interviews?

As part of the league’s announcement of the punishment of the team and Tom Brady for #DeflateGate, the Patriots admitted that “employees John Jastremski and James McNally have been indefinitely suspended without pay by the club, effective on May 6th.”
Jastremski was an assistant equipment man with the team, and a full-time employee, while McNally was a game-day attendant for the officials locker room, and the self-described “Deflator.”
The league announced that neither can be reinstated without league executive vice president Troy Vincent’s approval, and spells out that: “If they are reinstated by the Patriots, Jastremski is prohibited from having any role in the preparation, supervision, or handling of footballs to be used in NFL games during the 2015 season. McNally is barred from serving as a locker room attendant for the game officials, or having any involvement with the preparation, supervision, or handling of footballs or any other equipment on game day.”

I hear what you're saying. What I'm not seeing is direct evidence that Brady cheated or even told the ballboys to "cheat." He may have indicated that he liked the footballs on the lower end of the range, but is there any evidence AT ALL that he told them to deflate the balls below the "legal" range? Let me answer that for you: No.
