Can the league simply refure to give Edmonton either of McDavid/Eichel? That's just not fair to them.

Agreed. Perhaps the league should use part of the lottery system they employed for the 2005 draft. If you've had a top 3 pick in the last 5 years you lose a ball (also know ans the Kessel rule... sorry); if you've had a first overall in the last 5 years you lose 2 balls (also known as the Matt Cooke rule... not sorry). Each non-playoff team starts with an amount of balls proportionate to their standing in the previous year. The top 5 picks are determined by the lottery and then the order reverts to the order of finish.

It's an issue of precedent. If another situation like this comes along, they need to have a staunch example to work off of.
