How would that be determined?Seems to me that if someone makes a false accusation, they've made themselves a criminal.

So is r*pe and sexual assault and they’re the most under prosecuted crimes in the country. Gonna have to lump it.Filing a false charge is definitely a crime
Damn, they're both gone now.
Might have to binge the Sopranos again when I get some time.

isnt that just what Amber Heard did?Nope. Not worth it. It’s not even a problem. People just perceive it as such. Upwards of 95% of accusations are on the money. That doesn’t result in convictions. So here’s what happens when you codify that stupid shit into law:
1. Victims of r*pe will end up getting abused again by the system because a conviction wasn’t attained. That’s salt in a wound.
2. The reality is that most who come forward will get no recompense or justice to begin with in our system as is. Even fewer women will come forward when they run the risk of having to do jail time because r*pe is often a he said she said.
The whole belief that women come forward with false accusations to the point where it’s a problem is yet another example of r*pe culture in America. It’s disgusting to think that society would turn even further away from providing these victims justice. Now we’re making them criminals on top of that. This idea is Corky Thatcher level retarded.
I’m fine with a penalty for a flat out admission of guilt but beyond that? Nope. The same way it would be determined if the accused was guilty. You said the problem is that these are he said/she said situations. That goes both ways.
Google Brian Banks. He was a standout high school football player who had accepted a scholarship to USC. He wad accused and convicted of raping Wanetta Gibson. He spent 6 years in prison and 5 years on parole.
His conviction was overturned in 2012 when she confessed that she fabricated the whole thing.
To my knowledge, the only punishment she received was from the Long Beach Unified School District suing her because Gibson and her mother had sued them back when she made he accusation.
So a young man lost a scholarship and possible NFL career because of a false accusation and the accuser was never even charged with so much as filing a false police report.
I get that women need to be encouraged to report r*pe, etc. but that doesn't mean a woman who makes a false accusation shouldn't face consequences.

No.So all a woman has to do is not admit she lied and she faces no consequences.
That's not good enough.
Unless they are the President.Seems to me that if someone makes a false accusation, they've made themselves a criminal.
Duke Lacrosse.
That bitch should be under the jail.
In a unrelated turn of events, she is in prison for murder.
On the flip side....
Juries don't always get it right.
Dirt bags like R Kelly get away with sexual crimes all the time.
* see his 2008 acquittal even though they had the SCUMBAG on tape.
Just imagine the intimidation tactics that would be used by wealthy suspects if the victims knew they'd be prosecuted, and have a Leon on future earnings, if the verdict returns not guilty.
Unless they are the President.
* See lying ass Clinton and Trump
Lying ass Biden too...although, to be fair...he may not actually know that he's lying. lol
Honestly?Holy Shit. Didn't know that about the Duke LaCrosse accuser. Karma is a bitch sometimes.
I'm good with the death penalty for people like R. Kelly.
How do we encourage and protect women who really have been victimized and see that they get justice while also dealing with those who make false accusations with something more than...''well some guilty men get away with it, so it's okay if some innocent ones go to jail''.
I have 3 daughters and want them to be able to trust that they would get justice if one of them were assaulted...but I also have a son and would want him to be able to trust that he would get justice if he were falsely accused.
The million dollar question is...how do we get there?
Full blown dementia... LolLying ass Biden too...although, to be fair...he may not actually know that he's lying. lol
Wish you had the same energy for all of the victims of r*pe in America who never get justice. You’re worried about the car lacking fancy rims. You’re ignoring the broken engine. Your idea is going to have the unintended consequences of making a bad situation worse for victims. So all a woman has to do is not admit she lied and she faces no consequences.
That's not good enough.
Honestly?
I don't know.
It's one of the most vile crimes a person can commit.
I say a person because women do this kinda shit too.
But, it is also, along with child abuse, THE WORST crime that you can FALSELY accuse a man of committing.
Because, the stench does not dissipate if the charges are dropped or you are acquitted.

That would be helpful to a man who hasn't been arrested or one that can afford to pay bail.Yeah, I don't either.
There are always those who will always think he did it and some who will always have some doubt.
One thing I think could help is that, when we read/hear about these incidents, the womans name is left out of it. Maybe the mens names shouldn't be released unless he's convicted? At least maybe then a man who's innocent could avoid some of that stigma.
That would be helpful to a man who hasn't been arrested or one that can afford to pay bail.
It does nothing to protect the poor schmoos who are incarcerated awaiting trial.
Those guys are getting the shit beat out of them daily.
Because, inmate justice is swift.
It's immediate ass whoopings on sight.
The fact that we basically write sex crime on their forehead in permanent marker, by dressing them in a different color and having them housed in a specific unit, makes them very easy to identify, doesn't help.
Imagine enduring this and you're innocent.
