A woman who said she previously had a sexual relationship with Kaepernick told police April 3 that she passed out in Apt. 4710 in the Viceroy, 485 Brickell Ave., about midnight April 1.

“At 12:32, Miami Fire Rescue was dispatched to the Viceroy and transported a 25-year-old female from the Viceroy to the Jackson Memorial Hospital emergency room,” Miami Fire Lt. Ignatius Carroll said.

If true, that would tend to be good news for Kap et al. Thirty minutes is a pretty small amount of time, granted the sorts of things that he's accused of could be accomplished in a couple minutes.

Though apparently they did do a r*pe kit:

The woman underwent a r*pe test, sources said, and the results weren’t made public.

How did the police get there? If they (whoever the reporting party was) called 911, police probably responded the fastest.

1m A bit more in the Kaepernick/Patton/Lockette incident: Miami Fire Rescue says it was summoned to Viceroy Hotel by the Miami PD.

47s The Miami Police Department has not acknowledged that they were at the Viceroy before the woman in question was taken to the hospital.

P.S. This is starting to look bad. We might have to draft a QB if he gets charged.
It looks like she passed out and they got worried so they called the police. Thats how I am reading this, but who knows? could be anything at this point.

That's my read as well if the times in that article are correct, but these are also assumptions. I'd imagine this will shake out over the next few days/weeks.

If nothing comes out of this for Kap, he needs to grow up fast. He is the starting QB for a storied franchise and the face of it and all this crap does not look good. I am not saying don't have a good time, but avoid putting yourself in a precarious situation (3 guys 1 woman, bong and marijuana, etc.)

I hope he did nothing wrong. Don't get me wrong. I think I'm partly scared of the idea of having to go into the season with only Gabbert at QB.

Kap shouldn't have been anywhere near the marijuana, but honestly if being at a friends place/home isn't a good situation then we're all fucked. It can easliy be said 3 guys and 1 women with alcohol is a bad situation. 1 guy 3 females, whatever. The point being he wasn't in a place he shouldn't have been and he wasn't with the wrong crowd. He was with two friends/NFL players and a women he knew at least somewhat well. They weren't strangers, at a club, or whatever.

Honestly, all these comments about Kap should avoid being in a bad situation seem like they're not remotely being realistic about this or reading the reports. He's not going to sit at home in the offseason 24/7, with nothing but guys around.... Though that'd start a whole new shit storm of rumors.

This happened a week ago and the fact that the police have been very careful not to label it sexual assault means that there really isn't anything there or they would be all over Kap and crew by now.

She got wasted to the point she passed out, someone called the paramedics because she likely wasn't waking up, and the police just did their due diligence to make sure no funny business happened.

This case wouldn't be a blip on the radar if it didn't have a famous athlete involved and because it's the extremely dead part of the offseason where free agency is over and the draft is a month away it's even bigger news.

I've literally experienced both sides. I've seen a woman be sexually assaulted (I stopped it, but didn't report it so the guy did it twice more & I still feel like shit about that) and I've seen men be falsely accused of shit I KNOW they didn't do because I was there.

r*pe is grossly under reported and women are generally simply called whores, or that they deserved it, but at the same time an angry, unscrupulous "girl" can attempt to ruin someones life.

What this case needs is TIME. Jumping to conclusions isn't going to help, and if Kap did something wrong I'd be happy to lead the charge for him to go to prison, but we all need to let this play out.

I agree with this totally. The hospital has said they did a r*pe kit (not making findings public doesn't mean anything for or against Kap as it's a privacy issue) and if all the police are doing today is an "investigation" then they don't have much. I can understand things seem suspicous as at first glance this doesn't look good at all, but right now it looks much ado about nothing.

At Kap's age I probably would have put myself in that predicament. It is definitely immature and stupid, but hopefully Kap learns from this experience whether he is guilty or not.

If i'm the QB of the 49ers I'd live my life the way I want to live it though of course I wouldn't be doing anything overtly stupid. I rarely take shots nowadays and havent smoked weed since high school, but whenever I visit friends today the girls are frequently the ones drinking/mixing drinks, and taking bong hits in the garage so maybe I'm biased now that I think about it :doh:

However, Peyton Manning was accused of sexually harrassing a women back in the day and Brady cheated on his pregnant girlfriend so no ones a saint nowadays especially with everything on blast the minute someone hears about it.

Until more information comes out on the woman's tox screen, this appears to be a freak incident. I've never heard of any NFL QB in this kind of mess. Because it's an unusual circumstance. If it turns out that she just drank too much, and Kap called 911 and sent her to the hospital, what did he do that is so very bad, or shows such terrible judgment? Expecting any young person to stay away from marijuana entirely is unrealistic.
