Isn't a BB gun considered an assault weapon in California?

Considering these charges stem from a party in which people were shot, I doubt it was a BB gun

So he gets stabbed and two others are shot... Im assuming not by Smith.. But the DA brings charges against Smith.... how about you file charges on the people who are shooting and stabbing.

Since it was his property if I remember right he is the one that is held the most responsible for allowing this type of behavior on his property. It is like a parent that gives a kid a car but the car is still in the parent's name it is usually the parent that gets in trouble not the child who possibly hurts someone or damages property.

mmunition, magazines, and five rifles including -- an Armalite AR10-T .308 caliber rifle, a Bushmaster ACR rifle chambered for 5.56mm NATO and a Bushmaster Carbon-15 .223 caliber -- were found in Smith's home by Santa Clara County Sheriff's deputies following the June 29 party. Prosecutors said none of the weapons were registered with the California Department of Justice.

“California’s prohibition of these powerful weapons is not about hunting or target practice," Rosen said in a statement. "It is about interrupting the long history of death, carnage and grief assault weapons have inflicted on California communities.”

I own a few Ar's and a MAK-90 AK,thing is if they are not modified to Ca laws then yes it becomes a state offense, but since he moved them across state line's it is a double whammy, plus he had 30 to even 100 rnd mag's i bet.

(Personally i do not like any guns laws)

When the Fed's bring charges it can take up to a year or two.

I doubt he will be able to claim they are not his,all they need to do is look who bought them in AZ and squeeze the straw buyer and threaten charges.

Plus as the article state's those rifles were purchased while he was in Az for the Cards game,i doubt Mr Smith has legal residence in the state of Az.

The only caveat he may have and i doubt is that he bought a security business license to move those guns which he could under the (shell company) for security reasons..

What makes you think the DA didn't? Charges WERE filed against others.

Look all he need's to is make a plea deal with the Federal charge's.

The rest is easy,if the Feds decide to stick ala some Fed Prosecutor to make a name for him/herself will drag it out.

Then he is in trouble.

Here's the deal under California law you cannot have an AR15 with more than 5 round clip, and any handgun over 10 i believe.

That's state law.

But where he fucked up he brought guns with 30 round clips not registered over state lines, that's Federal.

Hey double, tell me about how you can take any gun apart and put it back together again in the dark while blindfolded with one arm tied behind your back and Metallica blasting at the highest volumes....

Let's reread the thread title...

Yep, this thread is about Alldone. It is not about a Seahawk fan.
Unless, maybe, you are so obsessed with Seattle that every thread needs to be steered that way...
