Another major developed took place in the Zion Williamson case on Wednesday as a Florida Appeals Court stayed Gina Ford’s Florida lawsuit.
The order, handed down in a one page decision, halts the litigation in Florida and moves the matter back to North Carolina - a venue sought by Williamson and his legal team initially in their hopes to invalidate a contractual agreement between the former Duke star and Prime Sports Marketing, LLC.
By virtue of Wednesday's appeals court ruling, the parties will now litigate the heart of the matter in the North Carolina forum. With the battlefield now set, it would appear as though Ford and her argument are unlikely to prevail owing to the fact that North Carolina's Uniform Athlete Agent Act (UAAA) expressly forbids a person from acting as an agent in the absence of obtaining registration from the North Carolina’s Secretary of State’s office. Ford was not registered at the time she signed Williamson, nor when she first contacted his parents in January of 2019.
While Ford provided no evidence of any of the allegations made last week, according to TheAthletic's legal analyst Daniel Wallach, now that the case will be adjudicated in North Carolina the issue of improper benefits - real or imagined - is irrelevant.
"Student athlete status comes from engaging in games," Wallach wrote while citing the relevant statute on his social media account. "[It's] independent from eligibility."
Last week's efforts drew a stern rebuke from Williamson's attorney, Jeffrey S. Klein who issued a statement calling the filing "a shameful attempt to distract from [her and Prime Sports Marketing]'s admitted violation of North Carolina law" and "a continuation of the predatory acts the agent statement was designed to protect against."
