So no, he didn't have the right to be there. If you get asked to leave in a bar and refuse to do so you are then trespassing. You don't have to right to defend yourself from the bouncers when their main job is to evict troublemakers.

First off, he was outside the bar. Second, even if he was and had been asked to leave, jumping him from behind would give him the right to defend himself.

What I said was;

And he left then was grabbed from behind. Seargent Stedanko did not identify himself.

An intruder KNOWS he is an intruder. Dennard knew he had the right to be on the street. Evidently at that point he did not know the city has it out for him.

He made a mistake in a heated moment. I'll give any guy in their early twenty's a break on that as long as he didn't seriously hurt anyone and at least LEARNED from it.

He was on probation and chose to drink and drive when he knew he had the money to call a cab and for fucks sake he's a BMOC so he could've called a dozen different willing people to come get him.

He fucked up. Here's to hoping he doesn't fuck up again because he's got a family who desperately needs his help and he's got an incredibly bright future.

He's not a bad kid. He's had some bad influences around him I think.
