"It was clear at the March 3 hearing at 40 Foley Square that Brady was in trouble with 2 of the 3 judges. Barrington Parker Jr and Denny Chin, relentlessly attacked NFLPA attorney Jeffrey Kessler. Bradys' decision to destroy his cell phone turned out to be a very bad idea......
Parker on Brady destroying his cell phone - "With all due respect to Mr. Brady, his explanation made no sense whatsoever".
Chin on Brady deflating footballs - "Evidence of ball tampering is compelling, if not overwhelming. How do we second guess the 4 game suspension".

The problem with this is comments or questions made during oral argument that don't end up in the opinion really don't mean anything.
And don't forget that these questions are in light of the great authority that Goodell is granted in the CBA. You can see this in the part where the two Jets fans talk about comparable punishments:
"And even if the fine for stickum use is the most appropriate analogy to Brady’s conduct, nothing in the CBA or our case law demands that the arbitrator discuss comparable conduct merely because we find that analogy more persuasive than others, or because we think the analogy the arbitrator chose to draw was “flawed” or “inapt.”"
