"It was clear at the March 3 hearing at 40 Foley Square that Brady was in trouble with 2 of the 3 judges. Barrington Parker Jr and Denny Chin, relentlessly attacked NFLPA attorney Jeffrey Kessler. Bradys' decision to destroy his cell phone turned out to be a very bad idea......

Parker on Brady destroying his cell phone - "With all due respect to Mr. Brady, his explanation made no sense whatsoever".

Chin on Brady deflating footballs - "Evidence of ball tampering is compelling, if not overwhelming. How do we second guess the 4 game suspension".

- Gary Myers, NY Daily News

The problem with this is comments or questions made during oral argument that don't end up in the opinion really don't mean anything.

And don't forget that these questions are in light of the great authority that Goodell is granted in the CBA. You can see this in the part where the two Jets fans talk about comparable punishments:

"And even if the fine for stickum use is the most appropriate analogy to Brady’s conduct, nothing in the CBA or our case law demands that the arbitrator discuss comparable conduct merely because we find that analogy more persuasive than others, or because we think the analogy the arbitrator chose to draw was “flawed” or “inapt.”"

Their ruling was based entirely on whether or not Goodell gave Brady the required fairness under their own agreed to rules, however they also did comment that there was compelling evidence that the balls were tampered with and he knew about it. They also commented about how damning it was that he destroyed evidence.

Those two things aren't mutually exclusive. They both made a formal ruling that did not consider the actual evidence, and made comments about that evidence. It was clear they do not agree with the Brady apologists.

Where is this in the opinion?

The cellphone thing is really bad for Brady. If he was being questioned for murder and destroyed his cellphone the judge would definitely consider that in his findings. Kind of like when Hernandez went home and destroyed all his home security cameras and footage. It may not 100% prove guilt, but it sure doesn't look innocent.

If Goodell can indefinitely suspend Hardy for dropped charges, then suspend Hardy even more the next season, he can suspend Brady for 4 games for perceived cheating, no matter how strong the evidence.

If the players don't like it, they can address it during the next CBA. THEY gave him this power.

Whats the compelling evidence? Thats what noone is actually saying. It sounds like it is just the judges opinion that they think Brady is lying.

Can someone please share this compelling evidence? It would make the story a whole lot clearer.

Who cares about compelling evidence? it's irrevelant. The only relevant thing is whether Goodell, in suspending Brady, was acting within the powers bestowed to him by the CBA. That is what the latest court ruling was about. The court/judge believes Goodell was acting within those powers and not exceeding power.

And that is why Thommy is going to serve a four game suspension. And this time it will not be delayed. it will happen.

True and raises the question: Why go through all of this bullshit ($5 mill investigation)? He basically can fine/suspend on mere suspicion, so why not just do it a week or two after the superbowl?

Dunno about that. Read the dissent and if he's got the chief judge on his side, might be worthwhile trying for a whole court rehearing.

Legal experts I've seen have been saying Brady's chances are extremely slim. Some think he'd have a hard time even getting a court to hear the case again.

No matter what kind of power Goodell has you don't just suspend Tom Brady, face of the NFL, without doing some investigating. Goodell was making sure his ass was covered before lowering the boom on the Pats and Brady.

I still smell a deal forthcoming.

The whole thing smells and the optics are brutal.

Nobody has won anything.

I think this is accurate too. Doesn't seem important enough to take up the so-called judicial resources. But you never know, some of those judges might be glory hounds.
