Colon is listed in the Biogenesis documents, same as Cruz (in the eyes of MLB, that's as good as guilty)

Difference, he served a suspension already, last year, for taking PEDs he's alleged to have received from Biogenesis, Cruz did not

Cruz never failed a drug test, but is listed in the documents, which MLB is NOW taking as a sign that he took PEDs, failed test or not

Since Colon has already failed a test, last year, for these same drugs (and has probably admitted to freely), he's not going to be suspended AGAIN, for being listed in the documents (which are being taken as a failed drug test)

The 2 issues that lie here:
1) Cruz has never actually failed a drug test, and his guilt is being assumed without any proof, luckily (for now) this isn't an actual court case
2) In many people's minds (including mine), Colon is obviously still doing something shady, BUT has not actually been caught via a failed drug test or any other documentation that links him to any drugs

No, because that would be a new offense. In Colon's case it he would be punished for the same offense twice, which is double jeopardy... something that is forbade by the 5th amendment.

It is not double jeapordy IF Colon when first suspended lied to investigators about the source of his PEDs. That would be a separate offense and can be punished as well.

Now there is a possibility that Colon DID confess the source of his PEDs and that is how MLB found the Biogenesis link to round up the rest.

no, he got suspended and they asked him where he got them, that's being in compliance, to not fess up would have mention more suspension time for him, ala Ryan Braun

Going to go out on a limb here and take a swag at the Cruz suspension. I think his lawyer and MLB go for the settlement (deal) and he serves 25-30 games this season instead of the standard 50 games.

A 50-game suspension hurts players and their teams. Max suspension that MLB ought to be able to levy on an active player is 50 games with the option of 25 games w/a fine equal to 25 game league minimum salary.
