Shanny was feeling the heat and Torres was an easy target with his rap sheet. Of course, several GMs and players then stated that they thought the punishment was much too harsh. It's a no-win situation.

I think the former factor, and the reluctance to have an appearance of conflict of interest from the latter, says that the appeal falls flat.

both parties are ok with independent arbitrators hearing salary matters ... why not discipline matters ... NHL has shown it's incapable of consistency in discipline decisions

Yeah, it's not as if they've haven't cut the legs out from under Shanny already. He tried to lay the law down early with a harsh suspension to Wiz and a couple of other players and GMs around the league started complaining. All of a sudden, we're back to the Colin Campbell "Wheel of Justice" and inconsistency.

In salary arbitration you are only disagreeing on the number of dollars in a contract, in disciplinary hearings you are sending messages and setting a tone on what is acceptable. The disciplinary hearings have a MUCH bigger impact on the sport and in turning that over to a third party the NHL would be possibly giving up a substantial amount of control over it's own league. I would never go for that as an owner.

Plus it would make them write a much more concise rulebook to limit the arbiters influence, and that sounds like a lot of effort...

great points but Im talking strictly about the appeals process ... ie is the number of games Torres was suspended consistent with other games suspended for similar acts ... just look at the number and the circumstances surrounding the punishable offence and find a comparable ... (sounds like salary aribitration) and have someone that is removed from the league preside over the appeal so there is no perception of bias

the NHL planted the seed in previous years that playoff games count for double time ... until shanny said this season anecdotally that they count for 10 times a regular season game ... I dont wanna sound like a defense attorney but wheres the fairness and consistency?
