I disagree....Most small claims are settled out of court for those reasons but high end cases, while aprox 70% is still settled out of court, it is because one of 2 things....Either the defendant does not think they can win the case, ala guilty, or it would cost more to defend themselves than to settle...

The vast majority of cases don't go to trial, so getting "settled" is normal way most of these cases end. You suggested he could never prove his case in 100 yrs...it really doesn't matter....a public collusion trial...even if they won the case, what positive can come out of it for the NFL?
