Just as petty theft and murder are both illegal, but not in the same spectrum...I get it. As far as the NBA rules, the word illegal is used, but none of the violations that occur are obviously really illegal. That discussion doesn't even belong here.

Flopping however is no worse then crying about being fouled when you knew you weren't, saying you didn't touch the ball last when you know you did, etc.., etc... All are attempts to manipulate the game in their teams favor.
