Kelly isn't allowed to make that call, of course they were fined. I spend most of my summers working in the safety industry and on our jobs we don't "advise" customers on what to do, we tell them how it's going to happen. Untrained civilians don't get to make that call. He fact that it was allowed to happen was a huge failure by any safety staff involved.

So who was there that "told" him how it was going to happen? You are saying Kelly did not make the decision, who did? Who told the HC at ND that it was safe? From the reports those in his chain expressed concerns about practicing outside. If you know it was not Kelly who gave the OK to practice outside over the concerns of those in the chain, who was it?
I don't understand why so many people, especially fans other than flahiduh, hate him. He seems like a pretty nice guy, its not like he acts like an ass like Spurrier or Harbaugh......

My point was that it shouldn't have been in Kelly's hands. He apparently did give the final word, but it wasn't his to give. That's why ND had to settle a court case. Someone unfamiliar with OSHA regulations isn't allowed to have any say in what equipment is being used.
It'd pretty much be like you walking into an operation and telling the surgeon what to do, that shit just doesn't happen.
