Lets see a pitcher throw a ball at a players head after he strikes him out while hes walking back to the dugout.
That is an equivalent.
That would be a crime.

You seem to be avoiding that the helmet swinger lost his job and is banned from the league.
Intentionally throwing at a hitter is more than a WP. Tell me, in the instance of an actual pitch if the pitcher hits the hitter on the forehead and kills him is he charged?
