Dimly lit, wet dirt track with a guy in a dark suit walking in the middle of the track? It's going to be hard to find Stewart guilty of anything other than bad judgement.
"Dimly lit" is to say he couldn't see him or know where he was. That wasn't the case. You could even see him clearly all the way from the stands on the front stretch.
"Wet dirt track" is to say he couldn't control the car. Again not the case, they were doing pace speeds and these cars are designed specifically to run in that condition.
"guy in a dark suit" is again to say difficult to see, not the case.
