Well, to be fair, there's a big difference between who came up with it (brainchild) and who owns it. TNA could very well be within their legal rights. It just a very very VERY stupid thing to do right now. They literally gain nothing from this. Even if they win a legal case, its not like Hardy is going to work for them. They'll basically just own "the Broken universe" but be able to not doing anything with it because its not like you can recast. And then there's all the massive amount of bad publicity they are getting right now at a time when they should be going for good press since they just relaunched.
If I remember correctly, WWF did the same type of thing with Nash/Hall back in the day. They decided to recast Razor Ramone and Diesel and use them as a joke basically, and Nash/Hall just used their real names in WCW.
I'd say it worked out best for WCW in that case, and in this case it'll most likely workout best for WWE, the scorned ex gf act almost never plays out well for the aforementioned.
